Quarter Finals – Lucky Draw
Terms and Conditions
1 These terms and conditions (“Terms”) shall apply to the lucky draw (“Lucky Draw”) conducted by Millionaireasia Pte Ltd (“MA”) from 1 February 2023 to 10 July2023 (both dates inclusive), or as extended (the “Lucky Draw Period”). By participating in the Lucky Draw, you understand and agree to be bound by these Terms and the decisions of MA in relation to and in connection with this Lucky Draw. This Lucky Draw is held in conjunction with the MsMA2023 Competition.
Entry period
2 The Lucky Draw Period is from 0001 hrs Singapore time, 1 February 2023 to 2359 hrs Singapore time, 10 July2023 (both dates inclusive). On 23 August 2023 (the “Draw Date”), MA will conduct a random draw (the “Draw”) at 1200 hrs Singapore time to determine a winner (“Winner”).
3 MA may change the Lucky Draw Period or the Draw Date as necessary based on the requirements of MsMA 2023 Competition.
Eligibility
4 A participant (“Participant”) must be a natural person of at least 18 years old and of legal age in his/her jurisdiction to participate in such lucky draws at the time of participation.
5 Categories of people who are not eligible to participate in the Lucky Draw:
(a) Persons from any jurisdiction in which it will be illegal to participate in the Lucky Draw.
(b) All employees of MA and its affiliates and their immediate family members (i.e. spouses, children, parents, brothers and sisters).
(c) All agencies and/or service providers engaged by MA (including but not limited to advertising agencies, promotions agencies, printing companies, event management agencies and any persons assisting or who are involved in the Lucky Draw) and their employees and immediate family members.
6 You confirm the accuracy and correctness of all information provided to MA at the time of entry in the Lucky Draw. Any misrepresentation of any facts or particulars will result in disqualification, forfeiture, withholding, withdrawal or recovery of any Lucky Draw won, at the absolute discretion of MA.
7 MA has the absolute discretion to determine the eligibility of Participants, which shall be final and conclusive. MA is not required to provide any reason for its determination.
Entry into the Lucky Draw
8 Each FoMo Silver Membership with Digital Certificate of Authenticity (DCA) held by a participant at 1200 hrs Singapore time on the Draw Date, represents one (1) entry (“Entry”) in respect of the Draw for a chance to win a cash prize of S$100,000 (the “Prize”).
9 There is no limit to the number of Entries any Participant may have.
10 The DCA, which comes with FoMo Silver Membership, may be obtained through the purchase of a Personality Video. To receive the DCA, each purchaser of a Personality Video will be required to complete a registration process via MA’s website, where personal information required by MA to administer the Lucky Draw will need to be provided.
11 Only FoMo Silver Membership with DCAs provided by MA are valid for participation in the Lucky Draw.
12 MA has absolute discretion to disqualify any Entry that does not meet the criteria set out in these Terms, which shall be final and conclusive. MA is not required to provide any reason for its determination.
Prizes, Determination and Notification of Winners
13 The Draw will be conducted at 1200 hrs Singapore time on the Draw Date (23 August 2023) and will be broadcasted on a real time basis. The general public can click on http://app.millionaireasia.com/ to view the draw on video. The result will be published on MA’s Marketplace Platform, within 24 hours, after the Draw.
14 At 1200 hrs Singapore time on the Draw Date, MA will draw at random, a Winner who will be entitled to the Prize. There will only be one (1) Winner.
15 The Winner will be announced on MA’s website https://millionaireasia.com/msma/lucky-draw after the conclusion of the Draw and remain on MA’s website for a period of two (2) months.
16 The Winner will be notified as soon as reasonably practicable and at the latest within 7 days of the relevant Draw Date by electronic mail and phone at their contact details as provided to MA during the registration process for receiving the DCA.
17 MA will agree with the Winner on a date to redeem the Prize. The Winner will be required to collect the Prize at: 25 Mohamed Sultan Road, Singapore 238969. Personal identification (NRIC or passport) with details matching the Participant’s personal identification details in his/her registration process for receiving the DCA must be presented to the authorised MA representative at the collection address in order to redeem the Prize on the agreed date. If the Winner fails to produce the required personal identification documents, his/her Prize will be forfeited (without any liability on the part of MA to any person). The Winner is responsible for any applicable remittance and related charges.
18 If the Prize is not redeemed within two (2) months from the Draw Date, the Prize will be forfeited. No claims will be entertained in the event of such forfeiture. The Winner whose Prize has been forfeited shall not be entitled to any payment or compensation whatsoever from MA.
19 If MA discovers that the Winner was not entitled to participate or if the Winner is subsequently disqualified from participating in the Lucky Draw, MA may at its discretion forfeit the Prize, reclaim it after award and then choose the next winner from the reserve winner list or donate the Prize to an approved charitable organisation of MA’s choice.
20 The Prize is not transferable and not exchangeable.
Others
21 MA shall not be responsible for any breakdown or malfunction in any computer system or equipment of network / internet connection that may impair a Participant’s participation or chance to win the Lucky Draw.
22 MA assumes no liability or responsibility and shall not be responsible or liable for any injury, loss, claim or damage whatsoever or for any charges, costs, tax or expenses of any kind whatsoever suffered or incurred as a result of the redemption or usage of the goods and services or the Prize or in connection with the Lucky Draw and/or redemption or use of the Prize and any consequences including, but not limited to, loss of life, injury to person and/or loss or damage to property arising from or in connection with the Lucky Draw, and/or use of the Prize howsoever arising.
23 MA assumes no liability or responsibility for and shall not be liable or responsible for any defect, quality, merchantability, the fitness or any other aspect of the Prize, or the goods/services offered in connection with the Lucky Draw. MA is not an agent of the Prize merchant. Any dispute relating to the Prize including but not limited to the quality or service standard must be resolved directly with the relevant merchant.
24 All decisions made by MA in connection with the Lucky Draw (including the interpretation of these Terms) including but not limited to, terminating, cancelling or suspending the Lucky Draw or to varying the Terms of the Lucky Draw or prohibiting a Participant from participating in the Lucky Draw, shall be final and binding on all parties to this Lucky Draw. MA shall not be liable for payment or compensation to any party. No appeal shall be entertained.
25 All Participants are participating in the Lucky Draw on their own free will and assume all risks and liability inherent in this participation. Participants will not hold MA and its directors, shareholders, affiliates, employees, agents, representatives, contractors and partners and the owner/operator of the Lucky Draw liable for any claims, demands, suits, causes of action of any kind whatsoever, costs, liabilities and/or expenses (including legal fees and disbursements) as and when they arise during the course of the Lucky Draw to the extent permitted by law including but not limited to injury to themselves and their friends and families, property damage, death during the Lucky Draw or on the premises where the Lucky Draw is/was held. Participants also hereby indemnify MA and hold it harmless against all losses, claims, demands, expenses and other liabilities (including legal fees) suffered or incurred by MA as a result of any breach of these Terms or of applicable laws by the Participants including, without limitation, any representation made by the Participants which is not authorised under these Terms or otherwise in writing by MA.
26 Participants consent under the Personal Data Protection Act 2012 of Singapore to the collection, use and disclosure of their personal information by/to MA and other third parties as MA may reasonably consider necessary for the purpose of the Lucky Draw and confirm that they agree to be bound by the Terms of MA’s Privacy Policy (https://millionaireasia.com/privacy-policy).
27 MA has the right to use the Winner’ name, image and/or voice for editorial, advertising, promotional, marketing and/or other purposes without further consent and compensation, except where prohibited by law.
28 A person who does not participate in the Lucky Draw shall have no right under the Contracts (Rights of Third Parties) Act (Cap.53B) to enforce any of these Terms.
29 In the event of any inconsistency between these Terms and any brochure, marketing or promotional material relating to this Lucky Draw, these Terms shall prevail.
30 These Terms and the Lucky Draw shall be governed and construed in accordance with the laws of the Republic of Singapore. Any unresolved dispute arising under, out of, or in connection with these Terms, including any questions regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force. Notwithstanding anything in these Terms, in the event of any dispute no party shall proceed to any dispute resolution unless the parties have made reasonable efforts to resolve the same through mediation in accordance with the mediation rules of the Singapore Mediation Centre for the time being in force.

Any translation from English to any other languages is purely for reference only. If there is any dispute as to the interpretation of any term or clause in any document, the English version shall govern.
